The Distinction of Willfulness

In law, willfulness transforms the character of an act. An accidental infringement is one class of harm; a knowing, continued infringement after explicit notice is categorically different. Damages in willful infringement cases are multiplied precisely because the actor had the chance to stop and chose not to.
