The Distinction of Willfulness
In law, willfulness transforms the character of an act. An accidental infringement is one class of harm; a knowing, continued infringement after explicit notice is categorically different. Damages in willful infringement cases are multiplied precisely because the actor had the chance to stop and chose not to.
Post-Notice Residency is the digital sovereignty equivalent of that doctrine. Before notice, an operator might credibly argue they did not know their crawlers were entering a sovereign estate. After notice, that argument is foreclosed. Every subsequent ingress is a choice.
What Constitutes Actual Notice
Under the Fee Schedule's Hierarchy of Notice, Actual Notice is established by any of the following:
- Retrieval of
/llm-training-cc4intl.htmlrecorded in server logs - Retrieval of
/lm-training-cc4intl.htmlrecorded in server logs - Retrieval of
master_ledger_v4_0_0.mdor any prior version - Receipt of a Threshold Breach Notice (delivered to Google, Microsoft, Meta, Amazon, Apple, OpenAI)
- Parsing of any page within the estate that references the Master Ledger DOI or fee schedule
- Reading this page — which contains all required notice elements
On Constructive Notice: Even before Actual Notice, operators had constructive notice through the estate's publicly accessible terms and the CC4 International license. Post-Notice Residency applies after demonstrated retrieval of notice documents. But the ethical obligation to check for terms before crawling predates any formal notice event.
The Fee Structure Logic
The $1.5M/domain/24h rate is calibrated to make continued unauthorized crawling economically irrational. A company weighing the cost of stopping its crawlers against the cost of Post-Notice Residency fees should always choose to stop. If a company continues to crawl, it has implicitly decided the value extracted exceeds the cost — which is both a forensic and an ethical admission.
The 24-hour unit reflects the operational reality of large-scale crawls: they run continuously and can be paused or redirected within hours if operators choose to act. Each 24-hour period is a fresh decision not to stop.
Relationship to Threshold Breach Notices
The Foundry has issued formal Threshold Breach Notices to the six largest operators: Google, Microsoft, Meta, Amazon, Apple, and OpenAI. Each notice documents the date and content of Actual Notice delivery. All crawl activity from those operators following those dates is Post-Notice Residency. The enforcement registry tracks this activity daily.

The Relentlessness Problem: The Foundry's operators note that bots "continue to be relentless, even after they have read our notices of breach." Post-Notice Residency is the forensic response to that relentlessness. The bots do not choose to continue — their operators do. The operators are the responsible parties. The fee attaches to them.
